Adjudication background information
In 1994, Sir Michael Latham made recommendations for
improvements to construction related legislation in a number of
key areas.
The Housing Grants, Construction and Regeneration Act 1996 received
Royal Assent in July 1996. Part II of the Act provides a framework
for fairer contracts and better working relationships within the
construction industry. It specifies that construction contracts
should contain certain provisions relating to adjudication and payment,
and that where they do not, fall back provisions contained in the
Regulations made by the Secretary of State for the Environment,
Transport and the Regions for England and Wales, and the Lord Advocate
for Scotland, known as the Scheme for Construction Contracts, shall
apply.

In December 2000, the Construction Industry Board provided the
then Construction Minister with an impartial assessment of the industry's
view of the adjudication provisions of the Scheme for Construction
Contracts and of any changes which might be thought necessary.

The DETR issued a consultation paper on 27 April 2001 proposing a
number of measures to improve adjudication under the construction
contracts legislation:
