BIS Survey on posted workers right

The Department for Business, Innovation & Skills (BIS) are thinking about how to best implement the EU Directive 2014/67/EU on enforcing the rights of posted workers which was published in June. A posted worker is a person who is employed in one Member State and sent to work temporarily in another Member State. Companies based in the UK may either post workers to carry out duties in other Member States, or receive ('host') workers from other Member States to undertake specific task, for example, specialist contractors.

The new enforcement directive has been put in place to ensure that workers are protected under the domestic law of the country they are working in, and that employers have clear information about their responsibilities and what information they need to hold on posted workers. This information will be used to ensure that, where needed, rights can be enforced effectively across borders.

In order to help determine the right policy response to the Directive, BIS are working with industry partners such as CIC to try and better understand how many posted workers they are and their characteristics.
