CIC Low Value Disputes Model Adjudication Procedure

CIC is developing a Low Value Disputes Model Adjudication Procedure (LVD MAP) to provide a simple and cost-effective procedure to make adjudication more accessible for SME’s and others involved in lower value claims.

The overarching objectives of the CIC LVD MAP are to provide a:

  • Clear streamlined adjudication procedure where costs are lower and more predictable.
  • Method of allowing newly qualified Adjudicators to gain experience deciding Low Value Disputes.

The CIC LVD MAP Consultation Second Draft is the result of the 4th June to 5th July 2019 consultation with the construction industry and other stakeholders from which comprehensive and informed feedback was considered leading to the improvement of the CIC LVD MAP Consultation Draft.

CIC LVD MAP general principles that the CIC is considered again are:

  1. Sections 2 and 40. Should the CIC LVD MAP require the Adjudicator to sit on one of the panels of qualified Adjudicators?
  2. Section 24. Should the CIC LVD MAP provide that Adjudicator may meet the Parties separately?
  3. Section 28. Should the CIC LVD MAP provide that the Adjudicator will make the Adjudicator’s Decision relying solely on the Adjudicator’s own experience and judgement? That is, the Adjudicator will not appoint any legal or technical advisor.
  4. Section 36. Should the CIC LVD MAP provide that the Adjudicator has the power to direct either Party to pay the ANB Application Fee?
  5. Sections 45 and 49. Should the CIC LVD MAP provide that Parties may choose to use the CIC LVD MAP where the claim exceeds £50,000?
  6. Section 48. What should the guidance on suitability include?
